Special Conditions of Sale of SPL AURAY CARNAC QUIBERON TOURISME

OFFICE DE TOURISME BAIE DE QUIBERON LE GRAND SOUFFLE to February 12, 2024

In accordance with article R211.4 of the French Tourism Code, the present Special Conditions of Sale (CPV) are
intended to inform customers of SPL AURAY CARNAC QUIBERON TOURISME - OFFICE DE TOURISME BAIE DE
QUIBERON, whose head office is located at 31 avenue de l'océan, 56340 Plouharnel, prior to signing the contract, of the information provided for in the aforementioned article. In accordance with article L211.9 of the French Tourism Code, this pre-contractual information will form an integral part of the contract and may only be modified by express agreement between the parties. These CPV may be modified and updated by the Tourist Office at any time. The applicable CPV are those in force at the time of booking. The present CPV are communicated to the customer at the time of booking a service with the tourist office and can be consulted and downloaded from the website: www.baiedequiberon.bzh


1. Formation of the contract

1.1 General terms and conditions

Booking any of the tourist services (accommodation, transport, stays, day trips
, guided tours, ticketing, leisure or sports activities, etc.) offered by the tourist office implies unreserved acceptance of the provisions of our Special Conditions of Sale by the individual or group customer.

For purchases of services on the www.baiedequiberon.bzh website, the order is finalized directly by the customer, the contract is automatically generated and payment constitutes full and final settlement of the price of the service(s) ordered.

1.2 Contract formation for stays with accommodation

All reservation requests must be sent to the Tourist Office either by e-mail to
n.ledain@baiedequiberon.bzh or by post to SPL AURAY CARNAC QUIBERON TOURISME - OFFICE DE TOURISME BAIE DE QUIBERON - 31 avenue de l'Océan - 56340 PLOUHARNEL or at one of the Tourist Information Offices of the Tourist Office, and will only be considered definitive once :

  • on receipt of the completed and dated contract or proposal, subject to confirmation
    by the tourist office, taking into account technical feasibility, available places and, where applicable, a minimum number of participants
    . The elements of the contract or proposal relating to the customer's particular requests take precedence over those appearing in the present CPV without prejudice to the texts in force;
  • and secondly, receipt of the balance for all bookings made less than 30 days before the start of the service, or a deposit of 25% of the total cost of the service in all other cases.
1.3 Formation of ticketing contract

All reservation requests must be sent to the Tourist Office either by e-mail to
accueil@baiedequiberon.bzh or by post to SPL AURAY CARNAC QUIBERON TOURISME - OFFICE DE TOURISME BAIE DE QUIBERON - 31 avenue de l'Océan - 56340 PLOUHARNEL or at one of the Tourist Information Offices of the Tourist Office, and will only be considered definitive once :

  • confirmation by the tourist office, subject to technical feasibility, availability of places and, where applicable, a minimum number of participants. The elements of the contract or proposal relating to the customer's particular requests take precedence over those appearing in the present CPV without prejudice to the texts in force;
  • and secondly, receipt of payment of the total cost of the services.

2. Conditions for performance of services

For all services sold by the Tourist Office, given their nature, certain modifications
may be made by the Tourist Office under the conditions set out in article 7.2 hereof, and given
that they are time-limited, they may under no circumstances be extended beyond the due date of the service. The customer must arrive on the day and at the time specified on the reservation contract, and, if applicable, with the exchange voucher, which must be given to the service provider.

In certain cases, and for certain services, compulsory equipment will be required (clothing, shoes, equipment, sun protection, etc.), or even supplied to ensure your safety, and will comply with health standards. Some services require a good level of physical fitness, or are even inaccessible to PRMs or pregnant women (long walks/distances, uneven ground - paths, cobblestones, steps, etc.), which each customer must appreciate. If you have any doubts about your physical abilities, we recommend that you contact the tourist office beforehand to obtain more information about the services available for your physical condition/capacity.

It is also the responsibility of each participant to observe the rules of caution and traffic, and to follow the advice of the
service provider, guide or tour leader throughout the tour. The tourist office may
exceptionally be forced to cancel a tour if the minimum number of participants is not reached. This decision will be communicated to the customer in accordance with article 6.2 of the present CPV. In the event of cancellation, all payments will be returned to the customer, without further compensation. All costs incurred by the customer will remain at the customer's expense.

2.1 For stays with accommodation

The accommodation services included in a package are calculated on the basis of the number of nights. Prices
include room rental and breakfast, or half-board, or full-board. Services included in the package are specified on the product sheet on our website or in our various brochures for each service. Unless otherwise specified in the contract, they do not include mealtime drinks or any other supplements.

When a customer occupies a room intended for two people, he/she may be billed a supplement known as the "single room supplement". When booking accommodation, customers are strongly advised to inform the tourist accommodation directly of their arrival time.

2.2 Ticketing

Tickets ordered subject to availability (seats, entrances, participants, etc.) may be dispatched at the customer's request to the delivery address given by the user at the time of ordering, either by e-mail or by post within 48 hours of placing the order, at the price of the current delivery charges, if the customer is unable to collect them from the tourist office. The delivery times specified at the time of order and/or on the contract are average times corresponding to processing times and delivery to Metropolitan France or abroad. Neither the service provider(s) concerned nor the tourist office can be held responsible if the delivery of tickets is rendered impossible by an error in the user's contact details, or by the user's failure to indicate the existence of an intercom or digicode.

2.3 For bookings of guided tours or other outings or nature walks by any means (horse riding, cycling, walking...) and other leisure or sporting activities

Each participant must arrive a few minutes before the start of the service at the meeting point
as indicated on the contract and/or voucher. If a participant is late, the service provider will still start the service at the scheduled time, and the service will remain due and cannot be reimbursed. Children are the sole responsibility of their parents. Practical information, such as the equipment or materials required to take part in the service, is given to the customer verbally at the time of purchase at the counter and on the voucher given to the customer.

2.4 Groups

For guided tours, unless otherwise specifically agreed with the tourist office, the meeting point and maximum number of participants are specified in the contract. As the different guided tours offered by the Tourist Office do not all meet the same requirements, the maximum group size may vary. Depending on the service, a contractual clause will specify the maximum size of each group and the number of guides present. If the group size is not as large as initially planned, the additional guide(s) must be cancelled at least 2 weeks before the tour. Otherwise, the additional guide(s) will be invoiced.


3. Withdrawal

The 14-day right of withdrawal does not apply to accommodation, transport, catering,
leisure services (ticketing, guided tours, etc.) which are supplied on a specific date or for a specific period in accordance with
article L121-21-8, 12° of the French Consumer Code.


4. Prices

All prices are displayed in euros and include VAT or according to the special regime for travel agencies. Unless otherwise stipulated in a service description and confirmed in the contract, the following are not included in the price: personal expenses, insurance, optional services not included in the service description. Price increases are only possible if they are the direct consequence of a change in the price of passenger transport resulting from the cost of fuel or other energy sources. The Tourist Office will provide the customer with proof of the price revision on a durable medium no later than 20 days before the start of the service.


5. Payment

All bookings are subject to payment of the total cost of the service, or payment of a deposit and a balance 30 days before the start of the service, depending on the type of service booked, as indicated on the contract. For services for which a deposit and a balance are paid less than 30 days before the start of the service, the full amount of the service must be paid at the time of booking. Payment must be made in euros, in the offices of the tourist office, within the limits stipulated by articles L112-6 and D112-3 of the Code Monétaire et Financier, by cheque: made payable to SPL AURAY CARNAC QUIBERON TOURISME - OFFICE DE TOURISME BAIE DE QUIBERON (a photocopy of your passport or national identity card may be requested), or in cash or by bank transfer or by credit card or VAD in the offices of the tourist office. The tourist office will send an invoice to the customer in accordance with the applicable legislation, after full confirmation of registration.


6. Cancellation conditions

6.1 By the customer

In accordance with article L. 211-14, I of the French Tourism Code, the customer may cancel the contract at any time prior to the start of the service, subject to compliance with the following procedure and refund conditions:

6.1.1 For stays with accommodation:

- Any partial or total cancellation must be notified by e-mail to n.ledain@baiedequiberon.bzh by telephone, at the counter of one of the Tourist Information Offices or by registered letter with acknowledgement of receipt to SPL AURAY CARNAC QUIBERON TOURISME - OFFICE DE TOURISME BAIE DE QUIBERON - 31, avenue de l'océan 56340 Plouharnel.

- Cancellation fees for services are as follows:

  • Cancellation more than 30 days before the start of the service: 10% of the price of the service, all taxes included,
  • Cancellation between 21 and 30 days before the start of the service: 25% of the price of the service including tax,
  • Cancellation between 8 and 20 days before the start of the service: 50% of the price of the service including tax,
  • Cancellation between 7 and 2 days before the start of the service: 75% of the price of the service including tax,
  • Cancellation less than 2 days before the start of the service: 100% of the price of the service including tax.

6.1.2 For ticketing :

- All partial or total cancellations must be notified by e-mail to accueil@baiedequiberon.bzh by telephone on 02 44 84 56 56, at the counter of one of the Tourist Information Offices or by registered letter with acknowledgement of receipt to SPL AURAY CARNAC QUIBERON TOURISME - OFFICE DE TOURISME BAIE DE QUIBERON - 31 avenue de l'Océan, 56340 Plouharnel.

In the event of cancellation, no refund will be made by the Tourist Office, except in the event of illness or death of a participant with a medical certificate. In these cases, full reimbursement will be made.

For maritime, leisure, transport and entertainment services sold in the name of the service provider, the latter's cancellation conditions will apply and in this case the refund will be made by the said provider. These conditions are available on the provider's website, and are indicated on the voucher given at the time of purchase.

Wherever possible, the customer will be offered the possibility of rescheduling the same service, with a surcharge depending on the rescheduling period requested.

A partial cancellation corresponds to a reduction in one of the elements of the service. The pro rata rule will be applied
on the basis of the compensation terms set out above. In the event of interruption of the service by the customer, no reimbursement will be made, except in cases of force majeure. These provisions do not apply where an amicable agreement has been reached for the customer to accept a substitute service offered by the Tourist Office.

6.1.3 For tickets purchased via the Tourist Office website

For maritime and leisure services, transport and shows, tickets are neither modifiable nor refundable, except in the case of force majeure as provided for in 6.3 of the present CPV.

6.2 On the part of the tourist office

In accordance with article L211-14, III of the French Code du Tourisme, the tourist office may cancel the contract and reimburse the customer in full for payments made, without the need for additional compensation, if : The number of people registered for the tourist service or package is less than the minimum number indicated in the contract, and the Tourist Office notifies the customer of the cancellation of the contract within the period specified in the contract, and no later than :

  • 20 days before the start of the service if its duration exceeds 6 days,
  • 7 days before the start of the service if it lasts between 2 and 6 days,
  • 48 hours before the start of the service if it lasts less than 2 days.

In all other cases, if the Tourist Office cancels the service before the start of the event, the customer, without
prejudice to any claims for damages, will be reimbursed within the period specified in 6.4 and without penalty of the amount paid. In addition, the customer will receive an indemnity at least equal to the penalty that
he would have incurred if the cancellation had been his fault on that date.

In all cases, the provisions of 6.1 and 6.2 do not apply when an amicable or contractual agreement has been reached between the parties. This agreement will then be formalized in writing.

6.3 Force majeure

The customer and the tourist office have the right to cancel the contract before the start of the service, without payment of cancellation fees, if cancellation or modification is imposed by force majeure, such as - by way of example but not limitation - the occurrence of a natural disaster, a meteorological event on administrative order or not, for which the captain decides not to leave port for the safety of the passengers, a health crisis, an armed conflict, a labor dispute, an imperative injunction from the public authorities (e.g. a national ordinance or prefectoral decree), a transport disruption, an operating accident - i.e. the occurrence of an unforeseeable event, beyond our control, which we are unable to overcome despite our best efforts to do so.

The party invoking force majeure related to any of the aforementioned events must notify the other party by any means in a clear, comprehensible and apparent manner on a durable medium as soon as possible. Where possible, the parties may consult each other prior to performance, to consider in good faith whether the contract should be continued or terminated. The party aggrieved by the non-performance of the obligation prevented by the event in question shall have the right to cancel the service without notice. In application of article 1218 of the French Civil Code, no damages or interest will be due.

6.4 Refund for cancellation

In the event of cancellation, and in accordance with the terms of article R221-10 of the French Tourism Code, the
tourist office will make the refunds required under II and III of article L. 211-14 or, under I of article L. 211-14, reimburse all payments made by or on behalf of the traveller, less the appropriate cancellation charges. These refunds to the traveler are made as soon as possible, and in any event no later than fourteen days after the cancellation of the contract. In the event of interruption of the stay by the customer, no refund will be made.

For maritime, leisure, transport and entertainment services sold in the name of the service provider, the latter's cancellation conditions will apply, and in this case the refund will be made by the said provider. These conditions are available on the provider's website, which is indicated on the voucher given at the time of purchase.


7. Modification

7.1 Modification by the customer

7.1.1 Stays with catering and/or accommodation

For the "stays with accommodation" section
Any request for modification before the start of the service must be sent by e-mail to
n.ledain@baiedequiberon.bzh . All modifications must be approved in advance by the Tourist Office.
As each request is treated on an individual basis, the Tourist Office is at the customer's disposal to study any contractual modifications or requests for additional services.
For the "catered" part of the package, no modification will be accepted less than 7 days before the date of the meal(s).

7.1.2 For tickets other than those purchased via the Tourist Office website, all requests for changes must be made no more than 48 hours before the start of the event, and must
be sent by e-mail to accueil@baiedequiberon.bzh. All modifications must be approved in advance by the tourist office, and will be billed at a flat rate of €2 per paying person. As each request is treated individually, the tourist office is at the customer's disposal to study any contractual modifications or requests for additional services.

For maritime, leisure, transport and entertainment services sold in the name of the service provider, the latter's modification conditions will apply, and in this case requests for modification must be made to the said provider. These conditions are available on the supplier's website, and are indicated on the voucher issued at the time of purchase.

7.1.3 Tickets purchased on the tourist office website

For maritime and leisure services, transport and shows, tickets cannot be modified or reimbursed, except in the case of force majeure as provided for in 6.3 of the present CPV.

7.2 Modification by the tourist office

In accordance with article L211-13 of the Code du Tourisme, the tourist office may, before the start of the service,
unilaterally modify the clauses of the contract other than the price in accordance with article L211-12 of the Code du
Tourisme, under the conditions and according to the procedures set out in article L211-13 of the Code du Tourisme. The modification must be minor, and the tourist office must inform the customer in a clear, comprehensible and visible manner on a durable medium:

  1. The proposed modifications and, if applicable, their impact on the price of the service,
  2. The reasonable period within which he must inform the Tourist Office of his decision,
  3. The consequences of failing to respond within the set timeframe,
  4. Where applicable, the alternative service offered, and its price.

If the modifications to the contract or the alternative service result in a reduction in the quality or cost of the trip or stay, the customer is entitled to an appropriate price reduction. If the contract is cancelled and the customer does not accept an alternative service, the Tourist Office will reimburse all payments made by the customer as soon as possible, and in any event no later than fourteen days after cancellation of the contract, without prejudice to compensation in application of article L 211-17 of the French Tourism Code.


8. Delay / overrun

When a service specifies a precise time and place for the start of the service, the customer must inform the tourist office as soon as possible by telephone at the number indicated on the exchange voucher. Any services not consumed as a result of this delay will remain due and cannot be reimbursed.


9. Transfer of contract

In accordance with articles L211-11 and R211-7 of the French Tourism Code, the customer may, as long as the contract has not produced
any effect, at the latest 7 days for groups and 12 hours for individuals before the start of the service, and by any means enabling acknowledgement of receipt to be obtained, inform the Tourist Office of the transfer of the contract to another person who satisfies all the conditions applicable to this contract and who meets the same conditions as the initial customer for carrying out the service. In the event of assignment, the customer and the assignee will be jointly and severally liable for payment of the balance of the price as well as any additional fees, charges or other costs incurred as a result of the assignment. The Tourist Office will inform the customer of the actual costs of the assignment, which must not be unreasonable or exceed the cost actually incurred by the Tourist Office as a result of the assignment of the contract.


10. Liability

The Tourist Office is the customer's sole interlocutor and is responsible to the customer for the performance of the
services ordered and for the obligations arising from these Special Conditions of Sale. It is fully responsible for the performance of the services provided for in the contract, whether these services are performed by itself or by other service providers, and is obliged to provide assistance to the customer in difficulty.

The tourist office cannot be held responsible for booking errors which are attributable to the customer or which are caused by exceptional and unavoidable circumstances, for the total or partial non-performance of the
services ordered in a case of force majeure as defined in article 6.3 of the present CPV, to the act of a
third party, to poor performance of its obligations by the customer, or in the event of fault on the part of the latter.

The customer shall inform the tourist office, as soon as possible in view of the circumstances of the case, of any non-conformity noted during the performance of a travel service included in the contract. The tourist information office cannot be held liable for damages of any kind that may result from the temporary unavailability of the site or from an interruption in the customer's connection during the registration, booking or payment process.

If one of the travel services is not performed in accordance with the contract, the tourist information office will remedy the non-conformity, unless this is impossible or would entail disproportionate costs, taking into account the importance of the non-conformity and the value of the travel services concerned. If the Tourist Information Office does not remedy the non-conformity within the reasonable period set by the customer, the latter may remedy the non-conformity himself and claim reimbursement of the necessary expenses.


11. Insurance

At the time of booking, the Tourist Office does not suggest that customers take out comprehensive or
cancellation insurance, but invites them to check that they also have this cover with the insurer of their choice, whom they
should contact directly in the event of a claim, other than one involving the full liability of the Tourist Office, before or during the service, in order to trigger the appropriate procedure.


12. Protection of personal data

The Tourist Office may collect personal data required to process
the registration or booking, to follow up on it, to send newsletters, promotions and solicitations or for quality surveys (via e-mail, telephone calls and post). The customer may unsubscribe at any time, either by clicking on the hypertext link provided for this purpose on each communication, or by sending an e-mail to dpo@baiedequiberon.bzh, or by post to SPL AURAY CARNAC QUIBERON TOURISME - OFFICE DE TOURISME BAIE DE QUIBERON - 31 avenue de l'Océan - 56340 PLOUHARNEL, providing proof of identity.

In accordance with the RGPD, the customer benefits from the right to access and rectify, update, portability and
deletion of data concerning him/her with the data controller of the Office de tourisme - dpo@baiedequiberon.bzh. Unless otherwise notified by the customer, the Tourist Office reserves the right to use this information to send the customer the various documents mentioned above. The customer also has the right to lodge a complaint with the CNIL.


13. Intellectual property / photos / illustrations

The photos, maps and illustrations contained in the brochures and/or website are illustrative and non-contractual. Any reproduction or commercial or non-commercial use of these elements is strictly
forbidden without prior written authorization. The repeated and systematic extraction of protected or unprotected
elements from the www.baiedequiberon.bzh website, causing any prejudice whatsoever to the tourist office or to one of its service providers or suppliers, is also prohibited.


14. Contract archiving

Any contract concluded with the customer corresponding to an order of more than 120 euros including tax will be archived by the tourist office for a period of 10 years in accordance with articles L213-1, R213-1 and R213-2 of the French Consumer Code. The Tourist Office will archive this information and produce a copy of the contract at the customer's request.


15. Complaints / Disputes

The present CPV are subject to French law.

Any complaint relating to a "stay" service must be sent to the tourist office by e-mail: to
n.ledain@baiedequiberon.bzh or by registered letter with acknowledgement of receipt within 7 days of the end of the service provided.

Any complaint relating to a "ticketing" service must be sent to the tourist office by e-mail: to
accueil@baiedequiberon.bzh or by registered letter with acknowledgement of receipt within 7 days of the end of the service provided.

In the absence of a satisfactory response from the Sales Department within 60 days, or if the response received is not satisfactory, the customer may appeal to the Médiateur du Tourisme et du Voyage(www.mtv.travel).

Any dispute that cannot be settled amicably will fall exclusively within the jurisdiction of the Vannes judicial court for a legal entity, and in the case of an individual, jurisdiction is assigned to the competent court in accordance with article L.141-5 of the French Consumer Code.
